Stalking

The word “stalking” is highly emotive and immediately makes you think about following another person around or watching them, but most of the time such cases have nothing to do with that. It is a serious offence which is becoming more and more common in the Courts. It is a complicated offence brought into force by legislation. It can be found in section 39 of the Criminal Justice & Licensing (Scotland) Act 2010. It involves a course of behaviour rather than a single incident.

 

The penalties for a charge of stalking can be severe and and can also involve Court orders not to have contact with the person again. It is imperative that you seek legal advice at an early stage to ensure your interests are protected and your case is fully prepared.
